The user shall be deemed to have accepted all the terms, conditions, policies and notices officially stated, as they continue to use the website and its services.

By visiting our website and/or purchasing something from us, you become a user of the website and engage in our “Services”. Such engagement will consecutively mean the user agreeing to be bound by the following terms and conditions (also referred t7o as “Terms of Service”, “Terms of use” or “Terms”), including those additional terms & conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the website including, but not limited to, users who are browsers, vendors, customers, merchants, affiliations and/ or contributors of content.

SECTION 2 – AVAILABILITY, PRICING AND PAYMENT METHODS

Availability and pricing of all items are subject to availability. Flemingoo.com will inform you as soon as possible, if the product(s) and services you have ordered are not available then we will refund your money.

As part of visiting and/or purchasing anything from Flemingoo, you warrant to agree to understand that due to the nature of the business, availability may change even after an order has been placed. In an event where the product is no longer available, then may be we will request you for giving us more time or take your money refund.

Pre-book products/items delivery date will be determined by Flemingoo.com and the respective brands. Delivery date will be mentioned on the specification of the product page. For delivery delay respective brands are liable. 

All prices are subject to change without notification, and while every effort is made to ensure the accuracy of the prices displayed on Flemingoo.com, they are not guaranteed to be accurate. If any price is different from that displayed we will inform you before dispatching the order and you will have the option of continuing with the order or not.

We reserve the right at any time to modify or discontinue any Service (or any part or content thereof) without notice at any time. We shall not be liable to any customer or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

SECTION 3 – PRODUCTS

Products are available exclusively online through Flemingoo.com. These products or services may have limited quantities and are subject to return or exchange only according to our Return and Replacement Policy.

Flemingoo has made every reasonable effort to be as accurate as possible in displaying the product in its original color and accurate size. However, due to your device’s display settings, technical issues and differences in display, variations may come to the product’s color or size. Hence, Flemingoo cannot guarantee that the physical product will look exactly like the display image. If a product from Flemingoo is not as described, your sole remedy is to return it unused by fulfilling all the conditions as per our Return and Replacement Policy.

 

SECTION 4 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting through the phone number or e-mail provided at the time the order was made. 

As a visitor or a customer, you agree to provide current, complete and accurate account information for all purchases made at our store. 

Each user accounts must be created under one distinctive registered Cell Phone number, and email address of the user. Multiple accounts cannot be created under the same information as mentioned. 

 

SECTION 5 – DISCOUNTS & ALLOWANCES

Discounts and allowances (Coupon code, Promo code, Gift card code, Adjustment code, App discount, Occasional offers or sign-up offer etc.) are reductions of the basic price of products or services. The value of the discount coupon or gift card will not be refunded on returns or exchanges after using for a successful order from Flemingoo.com. Users having multiple accounts under the same Cell Phone number, or email address cannot avail the discounts or offers more than once, as is the policy. 

 

SECTION 6 – THIRD PARTY LINKS

Certain content, products and services available via our Service may include wholly or partly, materials from third-parties only for the purpose of providing you with better service.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are neither responsible for examining or evaluating the content or accuracy, nor do we warrant any liability for third-party materials, website content, services or any other materials from third-parties.

SECTION 7 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our website or some Services containing typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information, on our or on any related website, is inaccurate at any time without prior knowledge.

SECTION 8 – ORDER CANCELLATION

Flemingoo.com also reserves all rights to cancel any order if the ordered product is unavailable or if it is out-of-stock. Product unavailability cannot be predetermined or predicted by the website, whether it is due to unavoidable inventory management issues, website management issues, vendor stock update issues or any other unpredictable reason.

 

SECTION 9 – PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the website or its contents:

(a) For any unlawful purpose.
(b) To solicit others to perform or participate in any unlawful acts.
(c) To violate any international, federal, provincial or national regulations, rules, laws, or local ordinances.
(d) To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
(e) To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability. 
(f) To submit false or misleading information. 
(g) To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet.
(h) To collect or track the personal information of others.
(i) To spam, phish, pharm, pretext, spider crawl, or scrape.

(l) Fake orders of any kind are not accepted and customers need to choose the method of payments as per company policy in order to receive deliveries of the products. Example: Customers not receiving an order after confirming it intentionally will be counted as a fake order.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

 

SECTION 10 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. It must also be stated that, most of Flemingoo’s products carry a Warranty, the user can avail the warranty directly at any brand authorized Servicing Point or through Flemingoo as well.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed and interpreted in accordance with the applicable laws governing eCommerce in Bangladesh. Any and all actionable legal claim or proceedings arising out of, or in connection to this website, must be brought within the jurisdiction of a competent Court in Bangladesh.

ফ্লেমিঙ্গু থেকে পরিদর্শন এবং/অথবা কিছু কেনার অংশ হিসাবে, আপনি এটা বোঝার জন্য সম্মত হন যে ব্যবসার প্রকৃতির কারণে, অর্ডার দেওয়ার পরেও উপলব্ধতা পরিবর্তিত হতে পারে। এমতাবস্থায় আমরা আপনার কাছ থেকে অতিরিক্ত কিছু দিন সময় নিতে অনুরোধ করতে পারি অথবা আপনি চাইলে প্রদত্ত অর্থ ফেরত নিতে পারবেন।

পূর্বেই বুকিংক্রিত পণ্য/আইটেম ডেলিভারির তারিখ Flemingoo.com এবং সংশ্লিষ্ট ব্র্যান্ড দ্বারা নির্ধারিত হবে। পণ্য পৃষ্ঠার স্পেসিফিকেশনে ডেলিভারি তারিখ উল্লেখ করা হবে। ডেলিভারি বিলম্বের জন্য সংশ্লিষ্ট ব্র্যান্ড দায়ী। 

সমস্ত মূল্য বিজ্ঞপ্তি ছাড়াই পরিবর্তন সাপেক্ষ, এবং Flemingoo.com-এ মূল্য প্রদর্শিত যথার্থতা নিশ্চিত করার জন্য সর্বাত্মক প্রচেষ্টা করা হলেও, সেগুলি সঠিক হওয়ার নিশ্চয়তা দেওয়া হয় না, যদি কোন মূল্য প্রদর্শন করা থেকে ভিন্ন হয় তবে আমরা অর্ডারটি প্রেরণের আগে আপনাকে অবহিত করব এবং আপনার কাছে অর্ডারটি চালিয়ে যাওয়ার বা না করার বিকল্প থাকবে।

Flemingoo.com এর মাধ্যমে পণ্যগুলি একচেটিয়াভাবে অনলাইনে পাওয়া যায়। এই পণ্য বা পরিষেবাগুলির সীমিত পরিমাণ থাকতে পারে এবং শুধুমাত্র আমাদের প্রত্যাবর্তন এবং প্রতিস্থাপন নীতি অনুযায়ী ফেরত বা বিনিময় সাপেক্ষ। 

ফ্লেমিংগু পণ্যটিকে তার আসল রঙ এবং সঠিক আকারে প্রদর্শন করার জন্য যথাসম্ভব নির্ভুল হওয়ার জন্য যথাসাধ্য চেষ্টা করে। তবে, আপনার ডিভাইসের ডিসপ্লে সেটিংস, প্রযুক্তিগত সমস্যা এবং ডিসপ্লেতে পার্থক্যের কারণে পণ্যের রঙ বা আকারে ভিন্নতা আসতে পারে। তাই, ফ্লেমিংগু গ্যারান্টি দিতে পারে না যে প্রকৃত পণ্যটি প্রদর্শন চিত্রের মতো দেখতে হবে। যদি Flemingoo-এর কোনো পণ্য বর্ণনা অনুযায়ী না হয়, তাহলে আপনার একমাত্র সমাধান হল আমাদের রিটার্ন এবং রিপ্লেসমেন্ট নীতি অনুযায়ী সমস্ত শর্ত পূরণ করে অব্যবহৃত অবস্থায় ফেরত দেওয়া। 

 

বিভাগ 4 - বিলিং এবং অ্যাকাউন্টের তথ্যের যথার্থতা

আপনি আমাদের সাথে যে কোনো আদেশ প্রত্যাখ্যান করার অধিকার আমরা সংরক্ষণ করি। আমরা, আমাদের নিজস্ব বিবেচনার ভিত্তিতে, প্রতি ব্যক্তি বা অর্ডার প্রতি ক্রয়কৃত পরিমাণ সীমিত বা বাতিল করতে পারি। এই বিধিনিষেধগুলির মধ্যে একই গ্রাহক অ্যাকাউন্ট, একই ক্রেডিট কার্ড, এবং/অথবা একই বিলিং এবং/অথবা শিপিং ঠিকানা ব্যবহার করা অর্ডারগুলি অন্তর্ভুক্ত থাকতে পারে। একটি ইভেন্টে আমরা যে অর্ডার পরিবর্তন বা বাতিল করি, আমরা অর্ডার করার সময় প্রদত্ত ফোন নম্বর বা ই-মেইলের মাধ্যমে যোগাযোগ করে আপনাকে অবহিত করার চেষ্টা করতে পারি। 

একজন দর্শক বা গ্রাহক হিসাবে, আপনি আমাদের দোকানে সমস্ত কেনাকাটার জন্য বর্তমান, সম্পূর্ণ এবং সঠিক অ্যাকাউন্ট তথ্য প্রদান করতে সম্মত হবেন। 

প্রতিটি ব্যবহারকারীর অ্যাকাউন্ট অবশ্যই একটি স্বতন্ত্র নিবন্ধিত ফোন নম্বর এবং ব্যবহারকারীর ইমেল ঠিকানার অধীনে তৈরি করতে হবে। উল্লেখিত একই তথ্যের অধীনে একাধিক অ্যাকাউন্ট তৈরি করা যাবে না। 

 

বিভাগ 5 – ছাড় এবং ভাতা

ডিসকাউন্ট এবং ভাতা (কুপন কোড, প্রোমো কোড, গিফট কার্ড কোড, অ্যাডজাস্টমেন্ট কোড, অ্যাপ ডিসকাউন্ট, মাঝে মাঝে অফার বা সাইন আপ অফার ইত্যাদি) হল পণ্য বা পরিষেবার মৌলিক মূল্য হ্রাস। Flemingoo.com থেকে একটি সফল অর্ডারের জন্য ব্যবহার করার পরে ডিসকাউন্ট কুপন বা উপহার কার্ডের মূল্য ফেরত বা বিনিময়ে ফেরত দেওয়া হবে না। নীতিমালা অনুযায়ী একই ফোন নম্বর বা ইমেল ঠিকানার অধীনে একাধিক অ্যাকাউন্ট থাকা ব্যবহারকারীরা একবারের বেশি ডিসকাউন্ট বা অফার নিতে পারবেন না। 

 

বিভাগ 6 - তৃতীয় পক্ষের লিঙ্ক

আমাদের পরিষেবার মাধ্যমে শুধুমাত্র আপনাকে আরও ভাল পরিষেবা প্রদানের উদ্দেশ্যে সহজলভ্য কিছু বিষয়বস্তু, পণ্য এবং পরিষেবাগুলির মধ্যে সম্পূর্ণ বা আংশিক, তৃতীয় পক্ষের সামগ্রী অন্তর্ভুক্ত থাকতে পারে ।

অধ্যায় 7 - ত্রুটি এবং ভুল সংক্রান্ত

Flemingoo.com অর্ডারকৃত পণ্যটি স্টকের বাইরে থাকলে যেকোনো অর্ডার বাতিল করার সব অধিকার সংরক্ষণ করে। পণ্যের অনুপলব্ধতা ওয়েবসাইট দ্বারা পূর্বনির্ধারিত বা ভবিষ্যদ্বাণী করা যায় না, এটি অনিবার্য ইনভেন্টরি ম্যানেজমেন্ট সমস্যা, ওয়েবসাইট ম্যানেজমেন্ট সমস্যা, বিক্রেতা স্টক আপডেট সমস্যা বা অন্য কোন অপ্রত্যাশিত কারনে হয়ে থাকে।

 

বিভাগ 9 - নিষিদাজ্ঞা ব্যবহারকারী

পরিষেবার শর্তাবলীতে উল্লিখিত অন্যান্য নিষেধাজ্ঞাগুলি ছাড়াও, আপনি আমাদের ওয়েব্সাইটে নিম্মবর্নিত বিষয়বস্তুর ভিত্তিতে ব্যবহার করা নিষিদ্ধ:

 

(ক) কোনো বেআইনি উদ্দেশ্যে।

(খ) অন্যদেরকে কোনো বেআইনি কাজ সম্পাদন বা অংশগ্রহণের জন্য অনুরোধ করা।

(গ) কোনো আন্তর্জাতিক, ফেডারেল, প্রাদেশিক বা জাতীয় প্রবিধান, নিয়ম, আইন বা স্থানীয় অধ্যাদেশ লঙ্ঘন করা।

(d) আমাদের মেধা সম্পত্তি অধিকার বা অন্যদের মেধা সম্পত্তি অধিকার লঙ্ঘন বা লঙ্ঘন করা।

(ঙ) লিঙ্গ, যৌন অভিযোজন, ধর্ম, জাতি, জাতি, বয়স, জাতীয় উত্স, বা অক্ষমতার উপর ভিত্তি করে হয়রানি, অপব্যবহার, অপমান, ক্ষতি, মানহানি, অপবাদ, অপমান, ভয় দেখানো বা বৈষম্য করা।

(f) মিথ্যা বা বিভ্রান্তিকর তথ্য জমা দেওয়া।

(g) আপলোড বা সংক্রমণ বা ভাইরাস বা অন্য কোনো ধরনের দূষিত কোড যা এমন কোনো উপায়ে ব্যবহার করা যেতে পারে যা পরিষেবার কার্যকারিতা বা ক্রিয়াকলাপ বা কোনো সম্পর্কিত ওয়েবসাইট, অন্যান্য ওয়েবসাইট বা ইন্টারনেটকে প্রভাবিত করবে।

(h) অন্যের ব্যক্তিগত তথ্য সংগ্রহ বা ট্র্যাক করা।

(i) স্প্যাম, ফিশ, ফার্ম, অজুহাত, মাকড়সার হামাগুড়ি বা স্ক্র্যাপ করতে।

(j) কোন অশ্লীল বা অনৈতিক উদ্দেশ্যে।

(k) পরিষেবার নিরাপত্তা বৈশিষ্ট্য বা কোনো সংশ্লিষ্ট ওয়েবসাইট, অন্যান্য ওয়েবসাইট বা ইন্টারনেটে হস্তক্ষেপ করা বা বাধা দেওয়া।

(l) কোনো ধরনের জাল অর্ডার গ্রহণ করা হয় না এবং পণ্যের ডেলিভারি পাওয়ার জন্য গ্রাহকদের কোম্পানির নীতি অনুযায়ী অর্থপ্রদানের পদ্ধতি বেছে নিতে হবে। উদাহরণ: ইচ্ছাকৃতভাবে নিশ্চিত করার পরেও গ্রাহকরা একটি অর্ডার না পেলে একটি জাল অর্ডার হিসাবে গণ্য হবে। 

আমরা আপনার পরিষেবা বা কোনও সম্পর্কিত ওয়েবসাইট ব্যবহার বন্ধ করার অধিকার সংরক্ষণ করি যে কোনও নিষিদ্ধ ব্যবহার লঙ্ঘনের জন্য।

 

ধারা 10 - ওয়্যারেন্টি অস্বীকৃতি; দায়বদ্ধতা সীমাবদ্ধতা

আমরা গ্যারান্টি দিই না, প্রতিনিধিত্ব করি বা ওয়ারেন্টি দিই না যে আমাদের পরিষেবায় আপনার ব্যবহার নিরবচ্ছিন্ন, সময়োপযোগী, নিরাপদ বা ত্রুটি-মুক্ত হবে। পরিষেবার ব্যবহার থেকে প্রাপ্ত ত্রুটি থেকে মুক্ত হতে পারে এমন ফলাফলগুলি সঠিক বা নির্ভরযোগ্য হবে বলে আমরা নিশ্চয়তা দিই না। ব্যবহারকারীকে অবশ্যই বুঝতে হবে যে, সময়ে সময়ে আমরা অনির্দিষ্ট সময়ের জন্য পরিষেবাটি সরিয়ে ফেলতে পারি বা যে কোনও সময়ে, যে কোনও পরিস্থিতিতে, আপনাকে পূর্ব বিজ্ঞপ্তি ছাড়াই পরিষেবাটি বাতিল করতে পারি ৷ 

এটাও উল্লেখ করা আবশ্যক যে, ফ্লেমিংগুর বেশিরভাগ পণ্যে ওয়ারেন্টি থাকে, ব্যবহারকারী সরাসরি যে কোনো ব্র্যান্ড অনুমোদিত সার্ভিসিং পয়েন্টে বা ফ্লেমিংগুর মাধ্যমেও ওয়ারেন্টি পেতে পারেন।

ধারা 11 - শাসন আইন

এই পরিষেবার শর্তাবলী এবং যেকোন পৃথক চুক্তি যেখানে আমরা আপনাকে পরিষেবা প্রদান করি তা বাংলাদেশে ই-কমার্স নিয়ন্ত্রণকারী প্রযোজ্য আইন অনুসারে পরিচালিত হবে এবং ব্যাখ্যা করা হবে। এই ওয়েবসাইট থেকে বা এর সাথে সম্পর্কিত যেকোন কার্যকর আইনি দাবি বা কার্যধারা অবশ্যই বাংলাদেশের একটি উপযুক্ত আদালতের এখতিয়ারের মধ্যে আনতে হবে।
